Skyer Law Supports Advocates for Children in Federal Suit: 150 Cases Submitted as Evidence

The DOE Implementation Unit is not an office many people are familiar with, but our lawyers and paralegals call this office on a daily basis, trying to get them to make payments on cases where we have winning decisions or pendency orders. It is the Implementation Unit that is the final step in the payment process and is responsible for the issuing of checks for these cases.

In spite of our having a good, collegial relationship with this DOE office, delays are increasing and causing a hardship to our families, to their providers, and to schools.   

Earlier this fall,  Advocates for Children and Milbank, LLP filed a motion in federal court requesting the appointment of an Independent Special Master to address the widespread and worsening delays in the DOE’s implementation of orders. This motion is predicated on an earlier lawsuit they brought in 2003 called L.V. v. NYC Department of Education. In 2007, the DOE agreed to settle this case with the families who brought it, and to adhere to benchmarks for improving implementation, including that the DOE would implement orders within 35 days.  But today the DOE is not meeting this modest commitment over 30% of the time. 

All members of the parents’ bar are experiencing these endemic delays. Our firm is working closely with Advocates for Children and supports their efforts in federal court.  As part of this, last week our lawyers provided AFC with a list identifying 150 of our most egregiously overdue cases to use as further evidence in its claims. It is our hope that this will help unclog the backlog and get our clients paid. There is no personal identifying information on this list; it is comprised of a case reference number (assigned by the DOE’s Impartial Hearing Office), the date of the order, the amount owed, and the name of the attorney from our office assigned to the case.  Our clients have no obligations regarding AFC’s court proceedings.  

We are proud to contribute to this critical effort, which we strongly believe will benefit all New Yorkers. We will keep you posted as the case develops.

Conference on Dyslexia, Oct. 21st

On October 21st, the NYC Bar Association is hosting a conference called Dyslexia: Children in Need of Identification and Representation. One of our attorneys, Paul Kohan, is a co-chair of this conference and our law partner Jesse Cole Cutler is a featured speaker.

This is a CLE event (generally attended by lawyers for professional credit), but it may be of interest to parents and professionals as well. A greatly discounted registration fee of $50 is being offered for non-lawyers, which includes lunch and all event materials. Anyone who can’t afford that fee is able to request a scholarship. Folks can register on the NYC Bar Association’s website.

The esteemed lunch speakers are Dr. Nadine Gaab, Associate Professor of Pediatrics at Harvard Medical School and NYS Assembly Member Jo Anne Simon, who represents parts of Brooklyn in Albany and has been a long-time champion of this community. Dr. Gaab will discuss the latest research on dyslexia, particularly with regards to early screening and early intervention. Assembly Member Simon will discuss her legislative work around early screening and early intervention.

At our first “Turning 5” workshop of this school year, three partners at the Skyer Law firm, Regina Skyer, Greg Cangiano, and Abbie Smith, will guide parents through the kindergarten transition process in NYC.

This is part two in a series of workshops sponsored by the Brooklyn Conservatory of Music’s Music Cares program. Part one is a lecture by special education consultant Sarah Birnbaum on September 26th.

The workshop is based on Regina Skyer’s indispensable 2015 book, How to Survive Turning Five, and is designed for parents of preschoolers and interested special education professionals of preschoolers. We will answer as many individual questions as time allows in a Q&A session after the presentation. Participants will learn about:

  • the legal rights of students with disabilities under the IDEA and relevant court decisions

  • the transition from CPSE to CSE

  • the continuum of programs available to all “turning five” students

  • what “pendency” is–and what it is not

  • the process for tuition reimbursement when no public option is appropriate

  • impartial hearings, appeals, and settlement procedures

  • the school application process in NYC

  • why independent evaluations matter, and

  • important tips and strategies to ensure a positive outcome

SPECIAL EDUCATION SYMPOSIUM: HOW TO NAVIGATE YOUR CHILD’S LEARNING DISABILITY DIAGNOSIS

Skyer Law partner Abbie Smith will be speaking on a panel at the Child Mind Institute’s 2nd annual Special Education Symposium. This is “a full-day workshop for parents of children in grades K-12 with language-based learning disabilities — including challenges with listening, speaking, reading, writing, spelling and mathematics.” The agenda includes panels about “evaluations, interventions, legal challenges, and admissions processes for local public, private, and learning support schools.”

Now that notices are filed, we are busy at work engaging with the district on settlement offers and drafting hearing notices. But we are never too busy to advocate for your child if a problem arises and we can help. Particularly this time of year there may be transportation issues beyond just a new driver familiarizing themself with a route. Don’t be shy about reaching out if you can’t solve these on your own.
